1. Terms of Service – WasteMarkt.com

§ 1. General Provisions

These Terms of Service, hereinafter referred to as the “Terms,” govern the rules for using the commercial services provided through the WasteMarkt.com website, hereinafter referred to as the “Service,” owned by Alicja Miazga, an entrepreneur registered in CEIDG, conducting business under the name 4Plast Alicja Miazga, hereinafter referred to as the “Operator.”

The Operator provides Services to the User consisting of making the Service’s resources available for posting advertisements, as described in §3, under the terms set forth herein.

The User enters into an agreement with the Operator on the terms defined in these Terms, unless a separate agreement provides otherwise.
Unless stated otherwise, these Terms constitute an integral part of the agreement between the User and the Operator.
The User is obliged to read the Terms before concluding the agreement.

The content of the Website (www.wastemarkt.com), including, in particular, the layout of individual pages, graphics, logos, and product photos, is the property of the Operator and is protected under applicable law, including in particular the Copyright and Related Rights Act of February 4, 1994 (Journal of Laws 2025, item 24, as amended) and the Industrial Property Law Act of June 30, 2000 (Journal of Laws 2023, item 1170, as amended).

Any copying, distribution, or publication of content posted on the Service requires the prior consent of the Operator.


§ 2. Definitions

For the purposes of these Terms, the following definitions apply:

  • User – an entity that has entered into an agreement with the Operator under the terms specified in these Terms, unless the agreement provides otherwise,

  • Terms – these Terms of Service,

  • Product – any item, product, or good offered by a User on the Service,

  • Service – the WasteMarkt.com website,

  • Operator or Administrator – the owner of the Service, i.e. 4Plast Alicja Miazga, NIP 8882935262,

  • Services – all paid services provided by the Operator to the User under an agreement concluded between them.


§ 3. Services

The Service enables the User, in particular, to:
(i) publish job advertisements,
(ii) publish buy/sell advertisements for raw materials and machinery.

The User may use the Operator’s Services by purchasing a subscription plan (membership), which allows the User to publish 10, 20, or 30 advertisements for a period of 30 days. The User may promote individual advertisements for an additional fee.

The subscription plan (membership) is automatically renewed for another 30 days unless the User declares the intention not to renew it before the renewal date.

The Operator informs that the purchase of a subscription plan (membership) also results in the User being listed in the “Our Brands” section of the Service.

Services are provided in digital form.


§ 4. User Account

Registration of an account is required to publish advertisements.
The User must provide truthful information.
The Operator reserves the right to delete the account in case of a violation of the Terms.


§ 5. Advertisements and Liability

The content of advertisements must comply with the law and public decency.
The Operator is not responsible for the content of advertisements posted by Users but reserves the right to remove them in case of a violation of the law, good morals, or third-party rights.
The Service does not verify the content of advertisements – the User is solely responsible for their content.
The Operator is not a party to transactions between Users.
The Operator has the right to moderate or delete any advertisement without stating a reason.
The Operator’s liability is limited to the provision of Services to the User.
By entering into an agreement with the Operator, the User acknowledges that the Operator bears no responsibility for physical or legal defects of the Product.


§ 6. Payments

Payments are made online through payment service providers specified on the Service.
Service prices are indicated in each offer on the Service and may change.
Unless agreed otherwise, the agreement between the User and the Operator is concluded at the time the payment for the Service is credited.
Unless agreed otherwise, the Operator shall begin providing the Service after payment of the price, which is stated in Polish zloty (PLN) including applicable VAT.
Payments are made to the Operator’s bank account, in cash, or in another form specified on the Service.

The amounts and payment deadlines indicated in the VAT invoice issued by the Operator are binding on the User. The payment date for bank transfers is the date on which the funds are credited to the Operator’s account.

The User agrees to receive electronic invoices sent to the email address provided.
In the event of payment delays, the Operator may suspend further service or terminate the agreement. If the Operator’s performance depends on prior payment, the time for performance shall be suspended for the duration of the User’s payment delay.


§ 7. Complaints

The User may submit a complaint regarding the Service via email to: office@wastemarkt.com.
The Operator will review the complaint within 14 days of its submission.


§ 8. Final Provisions

These Terms are effective as of November 1, 2025.
Any amendments to the agreement must be made in writing, electronically, or in documentary form under penalty of nullity.
Polish law shall govern all agreements. Agreements are concluded in Polish.
The Parties must promptly inform each other of any changes to their contact details.
The User may not transfer rights or obligations under the agreement to third parties without the Operator’s prior consent.
The Operator reserves the right to amend these Terms. Agreements concluded before amendments remain in force under the existing conditions.

In matters not regulated herein, generally applicable provisions of Polish law shall apply, including in particular the Civil Code, the Act on the Provision of Electronic Services, the Consumer Rights Act, and the Personal Data Protection Act.

The Parties agree to make every effort to resolve disputes amicably. In the absence of an agreement, disputes shall be settled by the court having jurisdiction over the Operator’s registered office.


2. Privacy Policy – WasteMarkt.com

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – “GDPR”), 4Plast Alicja Miazga, ul. Kolejowa 5, 82-230 Nowy Staw, NIP 8882935262, hereby informs that:

  • The Data Controller is 4Plast Alicja Miazga, ul. Kolejowa 5, 82-230 Nowy Staw, NIP 8882935262.

  • Providing personal data is voluntary; however, actions preceding the conclusion of an agreement, the conclusion of the agreement, and its performance require the provision of such data.
    Providing personal data is mandatory if required by law.

Personal data are processed for the following purposes:

  1. performance of a contract or actions at the User’s request prior to its conclusion – under Article 6(1)(b) GDPR,

  2. fulfillment of obligations and rights related to the agreement, which constitute the legitimate interest of the Controller – under Article 6(1)(f) GDPR,

  3. fulfillment of legal obligations – under Article 6(1)(c) GDPR,

  4. in other cases – based on prior consent, for the purposes specified in the consent statement.

Personal data may be shared with:

  • entities authorized by law,

  • IT system providers cooperating with the Controller to maintain continuity and security of operations,

  • postal or courier companies for correspondence delivery,

  • entities cooperating with the Controller in the ongoing business operations.

Personal data are not disclosed to other recipients unless required by law and are not transferred to third countries.

Data are retained for the period necessary to fulfill the purposes referred to above and thereafter for the period required by law. In particular, data are stored to enable the performance of pre-contractual actions, the execution of the agreement, and potential claim handling. Accounting documents are stored for the period required by tax regulations.

The User has the right to access their data, rectify, delete, restrict processing, object to processing, and request data portability.
If processing is based on consent, the User has the right to withdraw consent at any time, without affecting the lawfulness of processing before withdrawal.

The User has the right to lodge a complaint with the President of the Personal Data Protection Office (UODO) if they believe that data processing violates GDPR provisions.

Personal data are not used for automated decision-making, including profiling.
